This website is operated by LOOP8 LTD. Throughout the site, the terms "we", "us" and "our" refer to LOOP8 LTD. LOOP8 LTD offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, traders, and/ or contributors of content.

Section 1 - Online Store Terms

These Terms of Service do not affect your statutory rights. To order goods through this website, you must be at least 18 years of age and accept delivery within our served areas. We will accept each order for goods as an offer, by you, to purchase the goods subject to these terms.

You may not use our products for any illegal purpose nor may you, in the use of the Service, violate any laws in the UK (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

Section 2 - General Condition

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The titles used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain old information. Old information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the product (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the product.

 

Section 5 - Products

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear on the web shop. We cannot guarantee that your computer monitor's display of any colour will be accurate.

All the products we sell are of a technical nature and it is not always practical or possible to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturer's themselves.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person or geographic region. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

 

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by traders, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

Section 7 - User Comments, Feedback and Other Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by post, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, unfounded, derogatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain unfounded or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

 

Section 8 - Personal Information

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. By submitting information to LOOP8 LTD, you consent to the collection and use of this information by LOOP8 LTD. We do not sell, trade or rent your personal information to others, without your prior permission.

We do not store credit card details, nor do we share customer details with any 3rd parties. We use Internet standard encryption technology to scramble your personal data when you transmit it to us. This process is known as SSL (secure sockets layer). To check you are in a secure area of our website you can look at the site's URL and you will see a closed padlock or an unbroken key. This indicates that SSL is enabled and your transaction is secure.

 

Section 9 - Delivery

Next Business Day Delivery (For orders completed before 1PM). Orders after 1pm on Friday and any orders on Sat/Sun will be processed on Monday to be delivered on the Tuesday.

To help you plan for your delivery, we will send you an e-mail with your tracking details, as soon as your order has been shipped. However, please feel free to contact us on the initially advised delivery day for a tracking update.

Not all couriers work to predesignated time slots, or contact customers prior to delivery, so someone will need to be 'in' from 8am to 6pm on that day, at the delivery address, to sign for the goods. Because the items we sell are high risk, our couriers are legally contracted to deliver only to the delivery address given on your order. If no-one is 'in' at the delivery address to sign, our couriers will not normally deliver to any other address (e.g. a neighbour's). Please contact us for further details.

 

Section 10 - Returns Policy

We want you to be satisfied when you shop with us. However, occasionally, we know that you may want to return items. For information on this process please see our returns policy below.

The United Kingdom's Distance Selling Regulations stipulate that as a consumer, you have the right to cancel the contract for the purchase of any item within 14 working days of delivery. You must inform us of your wish to cancel in writing either by letter or email within a period of 14 working days. The period of 14 working days begins on the day after the day you receive your goods. You must take reasonable care of the goods and not use them. Business customers have no rights to return goods under the regulation.

Business customers: We charge a re-stocking fee of 15% of the final item price in the event that items are returned through no fault of our own (failed deliveries which are no longer wanted, purchase made in error, unsuitable etc.).

Business customers: We reserve the right to test "Unsuitable/ Faulty / Dead on Arrival" returns and impose a customer fee equal to 15% of the product sales price if the customer misrepresents the condition of the product. Any returned item that is damaged through customer misuse, is missing parts, or is in an unsellable condition due to customer tampering will result in the customer being charged a higher restocking fee based on the condition of the product. All goods returned must be returned including its original packaging.

 

Section 11 - Retention of Title

(a)The goods shall remain the property of the seller until full payment has been received (each order being considered as a whole) or until prior resale in which case the beneficial and legal entitlement of the seller shall attach to the proceeds of the resale or to the claim on those proceeds.

 

(b)Upon taking possession of the goods the buyer shall be a bailee of the goods for the seller until title has passed to the buyer and shall store the goods upon its premises separately from its own goods and shall clearly mark its goods, so that they are clearly identifiable as the goods of the seller.

 

(c)The buyer's right to possession of the goods will cease at the earliest of the following date:

i. On expiration of any agreed period of credit or the due date for payment of any invoice has passed.

ii. If being an individual he commits an act of bankruptcy or makes a proposal to his creditors or does anything which would entitle a petition for a bankruptcy order to be made, or the seller believes on reasonable grounds that the same is likely to occur.

iii. If being a company it goes into liquidation or does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding up or to apply for an Administration order or the seller believes on reasonable grounds that the same is likely to occur.

iv. If the buyer does or fails to do anything which may in any way imperil the title of the seller to the goods.

 

(d)The seller will have the right if paragraphs (a) (b) or (c) apply:

i. To repossess the goods.

ii. To use or sell all or any of the goods.

iii. To enter any premises of the buyer for the aforesaid purposes.

 

Section 12 - Warranty

All orders come with a 12 month RTB (Return to Base) warranty (unless otherwise stated). If there is a hardware fault after the first 14 days, you are responsible for safely returning the product to us. We can arrange collection for you at a cost. It is always better to return the product in the same packaging used by us.

WHO IS COVERED?

This warranty is non-transferable and covers only the original end purchaser. An original or copy of an order and product serial number (if applicable) will be required.

WHAT IS COVERED?

In the event of your PC hardware developing a fault you can return it for repair or replacement (or equivalent).

WHAT IS NOT COVERED?

• Normal wear and tear cause by product use

• Misuse, lack of care, mishandling, accidental damage, abuse or other abnormal use

• Use of the product other than for its intended purpose

• Damage caused by improper or unauthorized repair or maintenance

• Products that have been modified or altered

• Software issues (file corruption, internet setup etc.)

• Accidental damage like breaking the screen or liquid damage. You would need insurance cover for this.

• Used laptop batteries, although we do guarantee that they will hold at least one hour's charge. We will replace laptop batteries which do not meet this criteria if reported within one week of receipt and the battery supplied is returned. Batteries are considered as consumable items - as they are expected to degrade over time. Some may require replacement.

If a product is returned under warranty and has been damaged or there is a software problem we reserve the right to charge for our labour and carriage costs.

Warranty returns processing times vary. Although we aim to resolve your issue ASAP, workload can sometimes cause delay. Your submission of personal information through the store is governed by our Privacy Policy. To view our Privacy Policy click here.

 

Section 13 - Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund back to the original form of payment.

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

 

Section 14 - Prohibited Uses

LOOP8 LTD permits you to view and use the material and data on this Site solely for your personal and non-commercial use. The content of this Site such as text, graphics, images, and other materials are protected by copyright under both England & Wales and foreign law. Unauthorised use of the material may violate copyright, trademark, and other laws. You must retain all copyright and other proprietary notices contained in the original materials and on any copies you make of the material for your personal use.

You may not sell or modify the material in any way for any public or commercial purpose. The use of the material on any other web site or in any networked computer environment for any purpose is prohibited. If you violate the terms of this Agreement, LOOP8 LTD and Service Provider reserve the right to terminate your access to the site, and you must immediately destroy any copies you have made of the material.

Authority to use our data in a way that breaches these conditions must come in writing from us, and will only be valid for the time period specified in the letter.

 

Section 15 - Disclaimer of warranties; Limitation of Liability

In no case shall LOOP8 LTD, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

 

Section 16 - Indemnification

You agree to indemnify, defend and hold harmless LOOP8 LTD and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable lawyers' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

Section 17 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be cut from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

Section 18 - Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, overriding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any uncertainties in the interpretation of these Terms of Service shall not be construed against the drafting party.
